Agreement to Terms

By downloading, installing, or using the Workouts app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Workouts is a fitness tracking application for iOS devices that allows you to:

• Track workout sessions, exercises, sets, reps, weights, and times
• Create and manage custom workout routines
• Monitor personal records and fitness progress
• Sync data across your Apple devices via iCloud
• Integrate with Apple Health (optional)

User Accounts and Data

No Account Required: Workouts does not require you to create an account or provide personal information to use the App.

Your Data: All workout data you create remains under your control and is stored locally on your device and optionally in your private iCloud account. We do not have access to your workout data.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to harass, abuse, or harm others
• Distribute malware or other harmful code through the App
• Attempt to gain unauthorized access to the App's systems or data

Health and Safety Disclaimer

You acknowledge and agree that:

• You use the App at your own risk
• You should consult a physician before starting any fitness program
• The App's suggestions and calculations are for informational purposes only
• You are responsible for ensuring exercises are performed safely and correctly
• We are not liable for any injuries that may result from your use of the App

Intellectual Property

The App, including its design, functionality, exercise database, and algorithms, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Exercise Database: The exercise database included in the App is proprietary content. You may not extract, reproduce, or distribute this content outside of normal App usage.

App Store Terms

Your use of the App is also governed by the Apple App Store Terms of Service. In case of conflict between these Terms and the App Store Terms, the App Store Terms shall prevail regarding your relationship with Apple.

Updates and Changes

We may update the App from time to time to improve functionality, fix bugs, or add new features. These updates may require acceptance of new terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or this website. Continued use after changes constitutes acceptance of the new Terms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Termination

You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access to the App immediately, without prior notice, if you violate these Terms.

Upon termination, your right to use the App ceases immediately, but your workout data stored locally and in iCloud remains under your control.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the App is developed, without regard to conflict of law principles.

Severability
